Estate Planning
Pass on what you have earned to your loved ones with a Last Will and Testament or Living Trust. Nominate someone to serve as Guardian for your minor children until they reach adulthood. Appoint a Trustee to hold, invest, and distribute your children's inheritance until they reach a more responsible age and protect those assets from potential creditors. You can preserve a disabled beneficiary's eligibility for needed government benefits by directing their share be held in a Supplemental Needs Trust. Appoint someone to act for you if you cannot act for yourself with Advance Directives (Healthcare Proxy, Living Will, Power of Attorney). A comprehensive Power of Attorney appointing an Agent to handle financial and personal care matters for you may spare your loved ones from having to petition a court to have a Guardian appointed for you, and also gives you a say in who will be handling your affairs, rather than leaving it up to your loved ones to resolve without you.
Elder Law
When a loved one needs nursing home or skilled nursing care, having a skilled professional guiding you through the process can be invaluable. Long-term care can be expensive. Evaluating eligibility for government benefit programs like Medicare and Medicaid can seem daunting. If a loved one faces a sudden immediate need for long-term care, they should still be evaluated for benefits even if they have done no prior estate planning or you think they won't qualify because of assets or income. Advance planning for the possibility of needing long-term care in the future can help you preserve your assets and leave a legacy to loved ones with a combination of trusts, gifts, and insurance that is right for you and your family.
Probate and Administration of Estates
Losing a loved one is hard. Navigating the Surrogate's Court procedures while grieving is even harder. Finding assets, dealing with banks and insurance companies with their confusing forms and requests or "Letters Testamentary" can be daunting. When you lose a loved one, you need an attorney experienced in probate and Surrogate's Court practice to guide you through the administration of an Estate. Guardianship - MHL Art 81 or SCPA Art 17

If your loved one does not have a good estate plan with a comprehensive Power of Attorney, a guardianship proceeding can be contentious and costly.
